The breakneck speed at which legal developments occur has established itself as the new paradigm for the current century. It, therefore, seems fit to remember a famous phrase by the most recent Nobel Laureate for Literature, Bob Dylan: There is nothing so stable as change.

To illustrate this, the first article of this edition of SÉRVULO‘s Portuguese newsletter is by Sofia Carreiro, partner and co-head of the firm’s Corporate, Commercial and M&A department, and Marta Salgado Areias, associate of the same department, on the decision of the European Court of Justice on the provision of links to websites that refer to illegitimately published content in violation of the copyright of third parties, concluding that this act is also an act of communication to the public and as such it is in violation of said rights, contrary to what had been argued in the Advocate General’s opinion.

The second article is by Miguel Gorjão-Henriques and Inês Avelar Santos, respectively partner and associate of SÉRVULO‘s European Law and Competition Law department, and it focuses on Ordinance 256/2016, which establishes the rules on best practice for wholesale distribution of medical devices, and which entered into force on October 28. 

The following article, by Ana Luísa Melo, trainee lawyer in the Financial and Governance department, briefly presents the new European regime on PRIIPs – Package Retail and Insurance-based Investment Products.

Joana Pinto Monteiro, associate in the area of Real Estate, in her turn gives us an article on local accommodation (alojamento local), giving a critical view of the decision of the Lisbon Court of Appeal of October 20, 2016.

This is followed by a piece by Rita Canas da Silva and Paulo Câmara that discusses the new proposed law on gender equality in governing bodies, presented by the Government on January 18.

Diogo Feio, partner and head of SÉRVULO‘s Tax department, and Teresa Pala Schwalbach, an associate of the same department, analyse the proposed Budget for 2017, with a special focus on the amendment introduced to the new tax on real estate.

This issue in Portuguese of Momentum closes with an article by Rui Cardona Ferreira, partner of the Corporate, Commercial and M&A department, on the right of shareholders to information in groups of companies.
