Workplace Directions – August 2013

In this issue, I brief you on the highly publicised recent decision of the Full Federal Court in Commonwealth Bank of Australia v Barker which recognised implied duties of trust and confidence in employment contracts.

Andrew Cairns discusses a recent Local Court decision which dealt with payments of annual leave on termination. 
I also report on a recent determination of the Fair Work Commission in which the Australian Medical Association successfully opposed a low-paid bargaining authorisation sought by the Australian Nursing Federation.

Finally, Sudhir Sivarajah informs us on a decision  of the Federal Court of Australia which confirmed  that an employee taking action under work health  and safety legislation would be considered to be exercising a workplace right.
