Since 2012, a conflict began between KLM and a Panamanian company in relation to damage suffered by cargo. A judgment was rendered in late 2017 against KLM violating the limitation of liability provisions covered by the Montreal Convention which is signed and ratified by Panama as well as other provisions of Panama law.
Bearing in mind that this judgment could trigger a series of negative events for the aeronautical development of Panama and preventing a rogue legal precedent that does not recognize the aforementioned international treaties, the International Air Transport Association (IATA) as well as several important airlines such as UNITED AIRLINES, DEUTSCHE LUFTHANSA, COPA, LAN and others engaged Pardini & Asociados to file multiple Amicus Briefs against the aforementioned judgment in order to ensure the recognition of the limitation of liability provisions covered by the Montreal Convention and Panama law.
