New Ordinance (NO. 25/2021-DIREX/PF) extends the suspension of migratory periods and extends the period for Regularization with the Federal Police

New Ordinance NO. 25/2021 – DIREX/PF, of August 17, 2021 was published in the Official Federal Gazette, providing for the extension of the period for migratory regularization in the scope of Federal Police.

Considering that there is still a significant number of immigrants pending regularization in Brazil, with the gradual resumption of appointments with and service by the Federal Police, it should be stressed that the ordinance determines:

  • The period for the obtainment of residence permit, and for the registration of temporary visa of foreigners whose migratory documentation has expired as of march 16, 2020 is extended until March 15, 2022;
  • The immigrant who completes the regularization process within the period established will not be imposed penalty for the delay in the registration or overstay occurred in this period;
  • The administrative violations practices by the immigrants contemplated in this article and occurred on a date prior to March 16, 2020, do not benefit from the release of penalty.
  • This article is applied to immigrants and visitors who have the residence permit application and documentation required, but were not able to make an appointment due to the local restriction of the service unit.
  • The regularization protocols issued by the Federal Police and the national migration registration cards (CRNM), as well as provisional documents, expired as of March 16, 2020 are considered extended and valid, and should be accepts for all purposes until March 15, 2022, including for purposes of entry, registration, period renewal or conversion.
  • During the migratory regularization process passports, identification documents and criminal records issued abroad and expired after March 16, 2020 will be accepted, provided that the immigrant has stayed in Brazil and seeks to regularize their situation by March 15, 2022.

It is important to stress that in case of travels abroad whose sum of the duration outside Brazil exceeds thirty days, prevent the application of the provision of the main section. The ordinance shall enter into force on September 15, 2021.
