Legem Newsletter – SARS-CoV2 (COVID-19) – Specific technical guidelines for reinstatement of economic activities

In accordance with our previous newsletters regarding the suspension of non-essential activities from March 31 to May 30, 2020, declared by the Federal Government of the United Mexican States (“Mexico”) as consequence of the pandemic provoked by the virus SARS-CoV2 (COVID-19), we hereby inform you that the Ministry of Health issued a Statement establishing the Specific Technical Guidelines for Reinstatement of Economic Activities, which includes, among others, the following indications:

1. As of June 1, 2020, the “New Normality” stage begins, during which all workplaces must adopt the mandatory measures for reinstatement or continuation of activities.

2. All essential activities are obliged to carry out the online self-testing checklist via http://nuevanormalidad.gob.mx/ 

3. During the New Normality, filing the selftesting checklist will be a support tool in order for workplaces to comply with the measures established by the guidelines, provided that it will not be required to obtain a previous authorization in order to restart or continue operations. However, compliance with the referred measures may be verified and, if applicable, sanctioned through inspection visits from the corresponding authority.

4. Non-essential activities may start operations on a differentiated basis, for which the possibility and level of operation will be determined by: a) the state of the weekly traffic light of epidemiologic risk by regions; and b) the chart of epidemiologic risk levels.

5. For the purposes of the abovementioned, workplaces must identify: i) the type of activity (essential or non-essential); ii) the level of epidemiologic risk at the location of the workplace; iii) the size of the workplace; and iv) the characteristics of the workplace. Once these are identified, the possibility and degree of operation will be determined in accordance with the location of the workplace at the chart of epidemiologic risk levels.

6. Domiciliary safeguard for vulnerable groups must be kept during the maximumlevel alert.

7. As long as the Federal Government publishes the weekly traffic light of epidemiologic risk, we will continue sending it by e-mail every Monday.
