Digitization and the Challenges of Intellectual Property

Evolving from an analog mode to a digital form means more than a challenge. On this new spectrum many entities and individuals have struggled with whether to bolster or restrain their customary and habitual manners. They are either supposed to decide or felt forced to adapt to this new technological age. For some it is only a pathway to industry 5.0 which refers to cooperation between human and machine, not a new age. However, the vast majority of who believes the contrary are minded of the value of being part of digitization.

The real problem is likely the reality itself. The digitization is not exclusively or even most significantly a problem, it is the reality regardless of geography and nationality and there is no doubt that, such a singular focus on digitization deployment distracts those from the actual explanation for why so many law makers are required to regulate or curb to this neology.

Roland Sommer serves as Managing Director of the Austrian Platform Industry 4.0 since October 2015. The platform is a public private partnership that aims at improving framework conditions for the introduction of digitalization (‘Industry 4.0’) bringing together relevant stakeholders in Austria. The focus of the work is based on innovation in production technologies and business models on the one hand and high-quality working conditions on the other hand. Moreover Mr. Sommer is lecturer at the University of Applied Sciences in Wieselburg. Prior to this function he worked as Director of Public-Private Affairs for AVL List GmbH. AVL List is the world’s largest independent company for the development of powertrain systems with internal combustion engines as well as instrumentation and test systems. From 2004 -2011 Mr. Sommer worked as senior policy adviser for the Federation of Austrian Industries; there he was responsible for research and innovation policy, both on the national and the EU level. From 2000 to 2004 he was employed by the Austrian Research Promotion Agency respectively its predecessor institution. Mr. Sommer studied at the University of Natural Resources and Life Sciences, Austria, Wageningen University, the Netherlands, and the University of London, UK. He is active in various national and international bodies.

Monika Hupfauf is an attorney at law based in Vienna. Her practice has a strong focus on Life Sciences, Intellectual Property and Technology and ADR. Monika worked at a patent lawyer’s office and a cancer research center, was a partner in a business law firm and practiced several years in the IP and Technology Group of DLA Piper before becoming one of the founders of KOCH / HUPFAUF attorneys at law. Monika obtained her doctoral degree in the field of Intellectual Property Law and disputes and holds a degree in business mediation.  She is a registered mediator at WIPO and has in 2011 been admitted as judge at the Higher Regional Court of Innsbruck. Monika lectures at the University of Innsbruck and regularly gives workshops and presentations and publishes in the field of Intellectual Property Law and Life Sciences.

Şafak Herdem is the managing partner of HERDEM Attorneys at Law practicing on technology transaction having special focus on aerospace and defense industry. Şafak has started his career in a Canadian mining company and has been partnering to the firm more than 10 years. He is the author of the first and only legal book on Turkish Defense Industry and lecturing at Bilgi University on Emerging Technologies and Technology Transactions law at LLM programs.
