CBP Guidance on Filing Entries of Steel and Aluminum Exempted from Quotas

U.S. Customs and Border Protection has provided guidance on the entry filing of imports of steel mill articles and aluminum products granted relief from quotas imposed by the Trump administration under section 232 of the Trade Expansion Act of 1962.

CBP states that only products from importer(s) designated in a quota product exclusion approved by the Department of Commerce are eligible for that exclusion. CBP must receive and activate the exclusion number before any quota exemption can be processed and goods subject to the exemption can be released. As a result, importers or filers must submit a copy of the approved exclusion with the approved importer of record number to [email protected] and courtesy copy CBP’s Quota and Agriculture Branch at [email protected].

If quota amount is still available under the absolute quota category under which the import is classified, importers should do the following.

– in addition to the regular HTSUS chapter 72 and/or 73 number, report subheading 9903.80.60 for steel mill or aluminum articles with non-expedited quota approval or 9903.80.61 for steel mill articles with expedited quota approval

– not submit any other HTSUS number, including from Chapter 99

– use quota entry type (i.e., entry types 02, 06, 07, 23, 32, or 38)

– report the entered value of the commodity being imported on the appropriate Chapter 1-97 classification (except that Chapter 98 reporting provisions may require the entered value to be reported differently)

– transmit the product exclusion number in the importer additional declaration field (54 record) of the entry summary data in the format STLXXXXXX (for steel) or ALUXXXXXX (for aluminum), where XXXXXX represents the last six digits of the Regulations.gov approval number

If the quota amount has filled under the absolute quota category under which the import is classified, importers should do the following.

– in addition to the regular HTSUS chapters 72 and/or 73 number, report subheading 9903.80.60 for steel mill or aluminum articles with non-expedited quota approval or 9903.80.61 for steel mill articles with expedited quota approval

– not submit any other HTSUS number, including from Chapter 99

– use quota entry type (i.e., entry types 02, 06, 07, 23, 32, or 38)

CBP states that failure to follow these instructions may result in the quota exemption not processing and the entry being rejected.
